Terms of Sale
When purchasing wine from EWR, the customer automatically agrees to the following terms.
Age Verification
Persons who purchase and receive wine from EWR must be 21 years of age or older.
Guarantees, Drinkability, and “Corked” Wines
We guarantee that our inventory has been cared for and stored professionally. If you encounter a bottle that you suspect is flawed because of improper handling, please immediately put the cork back in the bottle and contact us immediately.
Because the character of wine changes with age and responds directly to its environment and how it’s cared for, we are unable to completely guarantee the "drinkability" of every bottle we sell. Nor can we be present to enforce such a guarantee.
European Wine Resource cannot be held accountable for “corked” wines or any other flaw that might occur at the time of manufacturing. These flaws are rooted from the wine making process and we often do not have any recourse with the manufacture over such flaws. While these types of flaws are rare occurrences, they are an unfortunate reality that fine wine consumers must face. Flaws related to the winemaking process should be addressed with the manufacturer.
As wine consumers, there are risks associated with purchasing and drinking aged wines that one must be willing to take. There is always a possibility that a wine may underperform, despite its appearance or handling. This is true of aged wines, young wines, as well as expensive and affordable wines. One’s level of comfortability in assuming these risks should be taken into consideration when purchasing and consuming expensive wines. We are happy to provide our clients with photos of their purchases, discuss provenance, and the likelihood of how their purchases may perform in advance of a sale. If you have concerns, please contact us before you place an order. We are always open and honest and strive to provide our clients with the best experience for their money. Refunds and returns
All sales are final. We do not offer refunds and returns. Please be sure you’re willing to commit to your purchase before placing an order. We are unable to accept claims for wines that have already been opened. We have no way of authenticating claims once the cork has been pulled from the bottle, we therefore cannot offer credits or accept returns for bottles that have been opened. If there is a problem with your order at the time of delivery, please contact us as soon as possible so we may resolve the matter.
Title and liability of wine in transit
The title to all wine purchased from EWR passes to the buyer within the state of California the moment payment is received. The purchaser is responsible for the shipment of orders placed with our company.
The purchaser is responsible for when they choose to ship their orders. Please be mindful of weather and temperatures before scheduling a shipment for your orders. If an order is placed without selecting the hold option, we will ship the order as soon as possible, as it was placed. EWR cannot be held responsible for weather-related damages while in transit. This is the customer’s responsibility.
EWR and its carriers cannot be held responsible for what may happen to orders while in transit. Customers are entitled to a refund for breakage or loss while in transit only if shipping insurance was purchased for the order. EWR and its carriers will not issue refunds for any other types of damages, such as the defacement of labels, corks, and capsules, spoilage, and all other forms of damage. EWR and its carriers cannot be held responsible for wines that become damaged from exposure to extreme temperatures or weather while in transit. If you receive bottles that have been broken during shipping, you must contact us within 24 hours of receiving the parcel.
Shipping Insurance
EWR offers insurance at a fee of 1% of the total value of the parcel for any shipment of wine completed by common carrier. Shipping insurance is optional and covers breakage or loss by carrier only.
In The Event of a Damaged Shipment that is insured
EWR will refund insured purchases for breakage or loss while in transit. EWR and its carriers will not refund shipments for any other types of damages, such as, the defacing of labels, the failure or damage to, corks and capsules, spoilage, and all other forms of damage. If you receive wine that has been broken or damaged during shipping, please contact us directly within 24 hours of receiving the parcel.
Warranties and Liability
While every effort is made to ensure that content is accurate and products are authentic, content and products obtained via third party resources and are not produced by us. The products, therefore, are offered “as is”. We make no representations or warranties in relation to the accuracy, completeness or authenticity of the products we sell.
While the content of this site is provided in good faith, we do not warrant that the information will be kept up to date, be true and not misleading.
We do not warrant that the servers that make this website available will be free from error, virus or bug free and you accept that it is your responsibility to make adequate provision for protection against such threats. We recommend scanning any files before downloading.
Nothing on this website should be taken to constitute professional advice or a formal recommendation and we exclude all representations and warranties relating to content and products.
In no event will EWR be liable for any incidental, indirect, consequential or special damages of any kind, or any damages whatsoever, including, without limitation, those resulting from loss of profit, loss of contracts, goodwill, data, information, income, anticipated savings or business relationships, whether or not advised of the possibility of such damage, arising out of or in connection with the use of this website or any linked websites.
Exceptions
Nothing in this disclaimer notice excludes or limits any warranty implied by law for death, fraud, personal injury through negligence, or anything else, which it would not be lawful for EWR to exclude.
